TAKS uses video surveillance to monitor and ensure that illegal goods do not cross the Faroese border. As the data controller, TAKS is responsible for ensuring that the footage is recorded and processed in accordance with the law.
Using video surveillance involves processing personal data. TAKS's authority to process this data is based on § 8, paragraph 1, number 5, of the Data Protection Act. If any criminal activity is captured in the footage, the authority to process it is based on § 13, paragraph 1, of the same law.

TAKS records at the airport in Vágar and at the terminal in Tórshavn.
If there is nothing criminal in the footage, only TAKS views it. If there is something criminal, the footage can be handed over to the police if they need it to investigate a possible violation of the law. TAKS is permitted to do this according to § 8, number 3, of the Surveillance Act.
TAKS does not share the footage with anyone other than the police.
The recordings are stored for 30 days and are then deleted. This is in accordance with § 8, paragraph 2, of the Surveillance Act.
However, § 8, paragraph 3, of the same law states that the recordings can be stored for a longer period if necessary for TAKS to handle a specific dispute. Before the 30 days are up, TAKS must inform the person involved in the dispute about this and, upon request, provide them with a copy of the recordings.

You generally have the right to access TAKS's processing of personal data concerning you. This means you have the right to confirm whether personal data about you is being processed and to access other details regarding the data, such as how long it will be retained and to whom it may be disclosed.
You have the right to have any incorrect information about you corrected.
In certain circumstances, such as when personal data about you is no longer relevant to us, you have the right to have it erased before it would be deleted according to standard rules.
TAKS is obligated to inform you when the institution processes personal data about you. For example, you have the right to be informed of the purpose and legal basis for the processing. If it is unreasonably difficult for TAKS to fulfill this obligation to each individual, the information should be provided in another publicly accessible way, such as on signs and the website.
Sometimes, the obligation to inform does not apply. For example, you may already know the information, or your interest in receiving the information may be outweighed by other private or public interests.
You have the right to object to otherwise lawful processing of your personal data if you have a specific reason for doing so.
In some cases, you have the right to have the processing of your personal data restricted.

The DPO has legal expertise in this area. The DPO ensures that TAKS complies with the regulations, acts as a contact person for citizens regarding the processing of their personal data, and liaises with the Data Protection Authority concerning the institution's data protection as a whole.
